These Terms of Service govern purchases and use of CheapAI digital services, including time-based plans, prepaid token products, subscriptions, and related support services.
1. Scope
These Terms of Service apply to all orders and uses of digital services offered through CheapAI. The offer is primarily intended for adults, freelancers, and businesses seeking access to AI models through compatible interfaces.
Customer terms that differ from these Terms apply only if expressly accepted in writing.
2. CheapAI Services
CheapAI organizes access to AI models through its own infrastructure, delivered API credentials, shared prepaid balances, token-based products, and time-based access products. The exact scope of each service is determined by the product description shown on the website at the time of purchase.
- Buy a Plan products provide time-based or package-based access as described on the product page.
- Load Balance products provide prepaid balance or token-style value based on the pricing logic shown on the website.
- Buy a Subscription products provide recurring access based on the selected subscription tier.
3. Contract Formation
Product listings on the website do not constitute a binding legal offer. They are an invitation to place an order. A contract is formed once CheapAI confirms the order or provides the purchased service.
After payment is confirmed, access data is usually delivered within 24 hours unless a different time frame is stated on the product page.
4. Prices and Payment
The prices displayed on the website at the time of purchase apply. All prices are final prices. Payments are currently processed in cryptocurrency using the wallet address and network shown during checkout.
A payment is treated as completed only after the transaction has received sufficient confirmation and can be clearly assigned to the order. Customers are responsible for selecting the correct coin, network, and amount.
5. Delivery and Use
CheapAI provides digital credentials, API keys, balances, or configuration details for compatible tools. Customers are responsible for storing access data securely and using it only within the agreed scope.
The following is prohibited in particular
- sharing or reselling personal access credentials without permission,
- using the service for unlawful content or abusive automated activity,
- attempting to bypass technical limits or protective measures.
In cases of serious misuse, CheapAI may temporarily restrict or permanently suspend access.
6. Term, Usage, and Expiry
Time-based plans end when the purchased term expires. Balance and token products remain valid until consumed or until an explicitly stated expiry date. Where a product page states No Expiry, this remains subject to applicable law, technical necessity, and continued commercially reasonable service availability.
For All-in-One or shared balance products, consumption speed may vary depending on the selected model. The product logic described on the website remains controlling.
7. Service Guarantee and Refunds
CheapAI makes commercially reasonable efforts to provide stable service. If a product page includes a service guarantee, that guarantee applies to the proper availability of the purchased service within the stated scope.
If access becomes permanently unusable during the guaranteed period for reasons attributable to CheapAI, CheapAI may choose to repair the issue, provide replacement access, or issue a reasonable partial or full refund.
No refund is owed where service issues result from third-party provider outages, general internet failures, customer misconfiguration, or violations of these Terms.
8. Liability
CheapAI is fully liable for intent, gross negligence, and damages arising from injury to life, body, or health. In the case of slightly negligent breaches of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract.
Otherwise, liability is excluded to the extent permitted by law. CheapAI is not responsible for the content, outputs, or decisions produced by the underlying AI models themselves.
9. Final Provisions
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a merchant or has no general place of jurisdiction in Germany, Berlin is the place of jurisdiction to the extent permitted by law.
If any provision of these Terms is held invalid in whole or in part, the remaining provisions remain effective.
